Terms
This is the agreement every client accepts before their site goes live (by replying "I agree" to my email). Prices shown are the current launch price.
1. What you get
A one-page website for your business, built for phones and computers and put live on your domain.
- You see the finished site before it goes live, and nothing launches until you say it's right.
- Before launch, one round of changes is included: wording, photos, hours, colours.
- Once it's live, the site is looked after under section 3.
2. Price and payment
- Setup (putting the site live): $250, once. Due within 7 days of the invoice, before the site goes live.
- Maintenance: $29 a month. Due monthly in advance, starting the month the site goes live.
- Payment is by bank transfer to the details on the invoice.
- I'm not registered for GST, so no GST is charged. Every invoice shows my ABN.
- If I register your domain, its yearly fee is included in the $29. If you already own a domain, you keep paying your registrar for it as you do now.
3. What the $29 a month covers
- Hosting, your domain (when I've registered it), and keeping the site online and secure (https)
- Up to 30 minutes of small edits a month, such as new hours, a menu or price change, a photo swap or a holiday notice. Unused time doesn't carry over.
- Edits done within 5 business days of your request. If I've told you ahead of time that I'm away, they may take longer, and I'll say when to expect them.
Not included, and quoted separately before any work starts: new pages or sections, a redesign, online shops or booking systems, logo design, photography, and paid advertising.
4. Your content and photos
The preview site uses information and photos that are already public, such as your Facebook page and Google listing. Before the site goes live, you confirm that:
- the business details on it (hours, prices, phone, address) are correct, and you'll tell me when they change
- you own the photos, logo and text on it, or have permission to use them. Photos taken by customers or other photographers aren't used unless they've agreed.
If you'd rather a photo isn't used, tell me and I'll swap it for one you send or remove it, free of charge. A few images may be generated illustrations rather than photos of your business. I'll point them out and replace them on request.
5. Your domain and who owns what
- Domain: registered in your business's name (a .com.au needs your ABN), so it's yours whatever happens. If you already own one, we use it.
- Your content (photos, logo, text, business details) stays yours.
- The site itself: I own the design and code while I'm hosting and maintaining it, and you have the right to use it for your business.
- If you leave: once all fees are paid, you can ask for a copy of the site files within 30 days and use them anywhere you like. If I registered your domain, I'll hand it over to you, and from then on you pay its yearly fee. The only thing you can't do is resell the design as a template.
6. Cancelling and late payment
- There's no lock-in. Maintenance runs month to month, and either of us can end it with 30 days' notice by email.
- When it ends, the site comes offline at the end of the notice period unless you've moved it elsewhere. Your files are available as set out in section 5.
- If a monthly payment is more than 14 days late, I'll email you first. If it's still unpaid 7 days after that, I may pause the site until it's paid. Nothing is deleted while it's paused.
- If you change your mind before the site goes live, you owe nothing.
7. The fine print
- No promised results. I build the site to show up well in Google, but I can't guarantee rankings, traffic or sales.
- Outside services. Hosting (Netlify), domain registrars, and anything the site links to (Uber Eats, DoorDash, booking or ordering widgets, maps) are run by other companies. I'll fix my side quickly, but I'm not responsible when their services go down or change.
- Liability. As far as the law allows, if something I did isn't right, I'll fix it or pay the cost of having it fixed. For anything else, my total liability is limited to the fees you've paid me in the previous 12 months.
- Your rights under the law. Nothing in this agreement removes your rights under the Australian Consumer Law, including that the work is done with due care and skill.
- Changes. Any change to this agreement, including the price, has to be agreed by both of us in writing (email is fine), with at least 30 days' notice.
- Law. This agreement is governed by the laws of New South Wales.
